What Premises Liability Means Under Oregon Law

Premises liability is a legal doctrine that holds property owners and occupiers responsible for injuries caused by unsafe or hazardous conditions on their property. Whether someone slips on an unmarked wet floor at a retail store, is attacked in a parking lot with inadequate lighting, or is bitten by a dog on a neighbor’s property, the legal question is the same: did the property owner fail to meet the duty of care owed to that person?

Oregon law recognizes three categories of visitors, and the duty owed depends on which category applies. Invitees, such as customers at a business, are owed the highest duty: the owner must actively inspect for hazards and address them. Licensees, people on the property with permission but not for the owner’s business benefit, must be warned of known hazards. Trespassers are owed the least protection, though owners still can’t intentionally harm them. Courts apply a reasonable person standard: what would a reasonable property owner have done to maintain safe premises under the same circumstances?

To establish a claim, the injured party must show that the property owner created the dangerous condition, knew about it and failed to act, or should have known about it through reasonable inspection. Sustaining an injury on someone’s property isn’t, by itself, proof of negligence.
